Our Story

In 2002, after practicing more than fifteen years in the area of intellectual property at Nims, Howes, Collison, Hansen & Lackert, and then at Fitzpatrick, Cella, Harper & Scinto, LLP, Rob started the Law Office of Robert L. Powley, which is now Powley & Gibson, P.C.

The firm has grown steadily over the last thirteen years with James M. Gibson joining the firm in early 2006 and Thomas Curtin joining in 2015.  Jim has practiced in the IP field for twenty years, having started his career at Morgan & Finnegan, L.L.P. and later becoming a partner at Fitzpatrick, Cella, Harper & Scinto, LLP.  Tom has been practicing in the IP field for 25 years starting at Nims, Howes, Collison, Hansen & Lackert where he became a partner, then of counsel at King & Spalding and partner at Lathrop & Gage before joining Powley & Gibson, P.C.  Keith Sharkin joined the firm as Partner in March 2016.  Keith has been practicing in the IP field for 30 years, having been a partner at Nims, Howes, Collison, Hansen & Lackert, then at King & Spalding, Dickstein Shapiro, and most recently at Reed Smith.  Tom, Rob and Keith met at Nims, Howes, Collison, Hansen & Lackert in the early 1990s. In addition to its partners, Powley & Gibson currently has eight attorneys and six support staff.

Trademark Practice Group

Attorneys at Powley & Gibson handle all aspects of trademark prosecution practice including U.S. and Worldwide clearance, counseling, filing and maintenance. Copyright Practice Group

Our attorneys counsel clients on a wide variety of copyright issues including timely preparation and filing of applications for registration before the Copyright Office, assignments and licenses, and other related transactions. Our attorneys also regularly litigate copyright cases both for plaintiffs and defendants in Federal Courts.

Our attorneys have developed significant expertise representing clients in the publishing, art and sports management industries, having filed dozens of lawsuits in federal district courts to protect their copyrights. Our copyright practice also includes issues pertaining to the Digital Millennium Copyright Act and “take down” practices with social media companies.

Patent Practice Group

Attorneys at Powley & Gibson have experience in all facets of establishing, maintaining and protecting comprehensive patent portfolios for our clients. This includes counseling patent application preparation, prosecution and litigation, as well as counseling our clients to help them realize their business goals.

We have successfully prosecuted patent applications in all technologies including the electrical, chemical, biotechnology and mechanical arts, as well as business method and software patent applications. Our attorneys are also experienced in evaluating the commercialization potential of an invention through investigating the scope and validity of third-party patents and providing freedom-to-operate opinions.

Rob founded Powley & Gibson in 2002 and has specialized in trademark, copyright and patent law for over 24 years. Frequently asked to advise on complicated intellectual property issues ranging from branding to litigation strategies. Rob’s extensive experience includes selecting, prosecuting, maintaining and enforcing trademarks, copyrights and patents worldwide.  Rob’s practice includes drafting and negotiating licenses and agreements involving trademarks, copyrights, patents, and domain names. He also litigates intellectual property rights in the Federal Courts throughout the United States, before the Trademark Trial and Appeal Board, and in alternative dispute resolution proceedings. He has also negotiated and constructed art exhibition, loan and sales agreements throughout the world.

Rob is also active in the not-for-profit area and serves on the board of directors for several companies. Rob has been recognized as one of the top 1000 trademark attorneys throughout the world, and is recognized as a “Super Lawyer” in New York.

Rob’s clientele includes a variety of domestic and international corporations, start-up companies, individuals, and not-for-profit organizations. Most notably, Rob has worked for one of the most successful Broadway musicals in history; large retail operations; food and beverage clients; a leading publisher in the energy and petroleum fields; the pharmaceutical industry; leading fashion companies; a world famous sculptor, and various other successful corporations, entities and individuals offering a wide scope of products and services.

James M. Gibson has over twenty-five years of experience practicing in the areas of trademark and copyright law.  Jim has extensive experience representing trademark owners in the United States with trademark prosecution at the United States Patent and Trademark Office and in both federal court and the Trademark Trial and Appeals Board.  Jim has worked closely with brand owners to develop trademarks, search and clear trademarks, prosecute trademarks at the United States Patent and Trademark Office and protect brands.

Jim also works with a network of experienced and reasonably priced attorneys around the world to protect clients’ rights worldwide.  Jim also has extensive experience in all phases of litigating trademark and copyright matters in federal courts.  Jim has represented a wide variety of clients in diverse fields such as publishing, financial services, fashion and sports management.

Thomas Curtin has over 25 years of experience in handling a wide variety of intellectual property issues, particularly in trademark, unfair competition and copyright matters.  Tom has represented Fortune 500 companies in federal courts and before the United States Patent and Trademark Office protecting their intellectual property portfolios.  He has litigated cases involving claims of trademark infringement, unfair competition, false advertising, dilution, cybersquatting, trade dress infringement, counterfeiting and copyright infringement.  Tom’s practice also includes counseling clients on trademark matters from search and clearance of marks to prosecuting applications before the United States Patent and Trademark Office and litigating opposition and cancellation proceedings before the Trademark Trial and Appeal Board.  He is also involved in licensing, internet-related issues including UDRP proceedings and has supervised trademark registration, maintenance and litigation matters worldwide.

Tom is licensed to practice before the United States Supreme Court, The Second, Ninth and Federal Circuit Courts of Appeals, the U.S. Southern and Eastern Districts of New York as well as New York State courts.  Tom is a member of the International Trademark Association, The Intellectual Property Section of the New York State Bar Association, the New York Intellectual Property Law Association and the Copyright Society.  Tom was selected among The Best Lawyers in America® 2013-2020.

Keith also provides counsel to clients on clearance of trademarks, prosecution of applications at the U.S. Patent and Trademark Office, brand management and enforcement, licensing, due diligence and international filings and litigation. Keith works closely with clients to meet their business objectives and resolve matters successfully and cost-effectively.

Keith is a member of the bars of the States of New York and New Jersey, and is admitted to the U.S. District Courts for the Southern and Eastern Districts of New York, the District of New Jersey, and the Second, Third and Federal Circuit Courts of Appeal. Bill has been practicing IP law since 1978. In those over 40 years, Bill has been one of the leading IP litigators in the U.S. regularly representing large U.S. and International companies in IP matters including trademark and trade dress infringement, false advertising, copyright infringement, patent and trade secret cases.

In addition to his intellectual property litigation work, Bill regularly provides counsel on all aspects of trademarks and copyrights, including proceedings before the U.S. Patent and Trademark Office, trademark clearance and protection of copyrighted works.

Bill has been named as one of the leading intellectual property attorneys in New York by Chambers USA (2012, 2013), selected to Super Lawyers (2007-2011) in New York IP litigation, named among the world’s top trademark attorneys by Euromoney International Investor, recognized in the Guide to the World’s Leading Trademark Law Practitioners (2008, 2012) and as one of the “World’s Leading Trademark Law Practitioners” by Managing Intellectual Property magazine.

Prior to joining Powley & Gibson, P.C., Bill had been a Senior partner at the firm Nims, Howes, Collison, Hansen & Lackert, a highly respected law firm that has been involved in much of the case law that provides the framework of today’s trademark law, and where many of us began the practice of IP law. Since 2002, Bill has been a partner at large general practice AMLAW top 150 law firms often in leadership positions.  Bill made the decision to return to an IP specialty firm to better serve his clients.  Admitted to practice law in the State of New York in 1978, Bill is admitted in the U.S. District Court, Southern District of New York, U.S. District Court, Eastern District of New York, U.S. District Court, Northern District of New York, U.S. Court of Appeals, Federal Circuit, and U.S. Court of Appeals, Second Circuit.

Bill graduated with an A.B. degree, magna cum laude and Phi Beta Kappa, from Dartmouth College in 1974, and received his J.D. degree from The Washington & Lee University School of Law in 1977.

Fritz represents clients in a variety of fields, and has substantial experience in the electrical, mechanical, and medical device fields as well as drafting and prosecuting business method and software patent applications.

Prior to joining Powley & Gibson, Fritz was Senior Patent Counsel for DePuy Synthes in Switzerland. Fritz also practiced law as an associate at Fitzpatrick, Cella, Harper & Scinto, and as a senior patent attorney at Jones Day before moving to Switzerland.

Fritz is a member of the New York Intellectual Property Law Association, the International Trademark Association and is licensed to practice law in New York State and the Commonwealth of Massachusetts. Fritz is also a registered Patent Attorney with the United States Patent and Trademark Office.

Fritz received his LL.M. from Boston University graduating first in his class, and his LL.B. from the University of Victoria Faculty of Law. Fritz also earned a Bachelor of Science in electrical Engineering from West Coast University summa cum laude and a Bachelor of Business Administration in Marketing from National University magna cum laude.

Diane B. Melnick specializes in domestic and international trademark matters, including clearance, prosecution, portfolio management, oppositions, and licensing. Diane has substantial experience in pharmaceuticals and medical devices, and has also represented clients in various fields, including industrial and electronic products, computer hardware and software, apparel, jewelry, accessories, and financial services.  Previously, Diane managed the trademark and domain name portfolios of the personal care division of a multinational corporation, including its product lines for skin care, sun care and infant feeding. Diane has handled trademark clearance and prosecution around the world for many brands, small and large. She has also handled the trademark component of business transactions, including mergers and acquisitions.

As a former Trademark Examining Attorney at the United States Patent & Trademark Office, Diane brings an in-depth practical experience to the substantive and procedural issues surrounding the prosecution of U.S. trademarks.

Diane is the co-author of Chapter 6 (“Extraordinary Circumstances and Relief”) of Trademark Infringement Remedies, 3rd Edition, published by Bloomberg BNA, in association with the American Bar Association’s Section of Intellectual Property Law. This chapter discusses the processes and standards for Temporary Restraining Orders in trademark litigation, as well as Ex Parte Seizure Orders and Asset Freezes, addressing the requirements for each and examines cases in which they were granted (and denied) on a circuit-by-circuit basis.

Diane is licensed to practice law in the states of New York and Michigan, and in the District of Columbia. She is admitted to practice in the United States District Courts for the Southern and Eastern Districts of New York as well as the Eastern District of Michigan. Diane is a member of the International Trademark Association and the Association of the City Bar of New York.

Diane graduated from the University of Michigan, Honors Program, with a major in political science and received her J.D. from Emory University School of Law.

Playing a key role in successful jury trial litigation of claims of willful copyright infringement, obtaining multi-million dollar judgment including a substantial award of attorney’s fees and costs

Litigating patent infringement claims in the areas of antivirus software, semiconductor chips, vehicle navigation software, satellite radio receivers and pharmaceutical products under the Hatch-Waxman Act.

Participating as second chair during 39-day trial on false advertising claims under the Lanham Act that included seven expert witnesses and 34 fact witnesses, obtaining extensive injunctive relief and one of the highest false advertising damage awards then on record.

Trying asylum cases before the U.S. Immigration Court and successfully obtaining asylum for over a dozen pro bono clients from countries including Colombia, Iran, Chad, Tibet, Cote d’Ivoire, Grenada and Jamaica.

From 2009 to 2010, Matthew served as law clerk to the Honorable Francis M. Allegra, United States Court of Federal Claims.   Prior to joining Powley & Gibson, Matthew was an associate at Kramer Levin Naftalis & Frankel LLP in New York City.

Matthew is a member of the International Trademark Association, the New York Intellectual Property Law Association and the Copyright Society of the USA.
